Terms and Conditions
The purchasers of products and/or services from 100% Reef Safe are subject to the following terms and conditions. The term “Purchaser” shall mean the party placing an order with 100% Reef Safe and identified as such in any document attached hereto, this document and all attachments are hereinafter referred to as “this Agreement”. The terms and conditions set forth in this agreement shall constitute the entire agreement between 100% Reef Safe and Purchaser relating to the sale of the products and/or services described in any attachment, or in an subsequent purchase or sales order. No conflicting or final terms or conditions which may appear in any order or other document of Purchaser shall be of any force or effect unless accepted and agreed to in writing by us 100% Reef Safe.
Price
The prices under this agreement are subject to change and inclusive of GST. The prices set forth shall be in effect until notice from 100% Reef Safe. The price shown is correct at time of posting subject to errors and omissions. 100% Reef Safe reserves the right to adjust prices at its discretion with proper notice to Purchaser.
Delivery
100% Reef Safe will pay the freight and bill Purchaser for shipping and handling charges.
Please note that Livestock Shipping isn't calculated on checkout and is done once the order is received as there are too many shipping variables.
Some things like livestock do not trigger a freight option as freight charges vary hugely depending on where it's going & what is ordered. We also found people would often choose an inappropriate freight option which would take a week or more & that is never going to end well. Please contact us if you’d like a quote on freighting your order to you or place the order and we will be in touch to discuss freight options.
Product weights on the "Your Shopping Bag"/"Invoice" page are for shipping purposes and may not be the actual weight of the item. Where possible we have included the actual weight of the product in the product description. Purchaser assumes all risk of loss during delivery of the Products by 100% Reef Safe to the carrier. In the absence of instructions to the contrary, 100% Reef Safe, on behalf of the Purchaser, shall exercise its own discretion as to the method of shipment to be used and the selection of the carrier but shall not be deemed thereby to assume any liability in connection with the shipment nor shall the carrier thereby be deemed an agent of 100% Reef Safe. No goods shall be returned for credit or replacement without prior authorisation by 100% Reef Safe. All goods returned without such prior authorisation will not be accepted by 100% Reef Safe and will be returned to the purchaser.
Returns
If you are dissatisfied with your purchase for any reason, please email us at pete@100percentreefsafe.com.au. No returns will be accepted if prior arrangement has not been made. All warranties on goods are as manufacturer’s warranty where applicable, we encourage you to take such matters up directly with the manufacturer. If you need assistance with this we are happy to help you. Returns will not be accepted if you have simply changed your mind.
Unfortunately we will accept no returns on any of our perishable items (fish, live rock, invertebrates or corals).
Terms of Payment
Except as otherwise stated in any attachment, terms are net due upon purchase. Payment methods accepted are Direct Deposit, Paypal(Subject to +3% Paypal Fees), Cash(For Customer Pickup Only). Buyer shall pay invoice with in 5 days before the order is terminated to free up allocated stock.
Paypal and credit card fees can be passed onto the customer at 3%, no charge for Direct Deposit or cash applies. Direct deposit payments may take 1-2 days to clear dependent on banks or credit unions processing times
Disclaimer and Limitation of Liability
100% Reef Safe shall in no event be liable for damages, including but not limited to incidental or consequential damages, for injury to any property or to any person, by reason of the person's negligence or otherwise in connection with the safe, delivery, installation or use of the products and/or provision of services pursuant to this agreement, and purchaser shall indemnify and hold harmless 100% Reef Safe against further liability. Without limiting the generality of the foregoing, 100% Reef Safe shall in no event be liable for lost profits arising out of, or in connection with, this agreement. Neither 100% Reef Safe nor purchaser shall be liable for delay in the performance of any of its obligations under this agreement arising out of causes beyond its control, including but not limited to acts of God, governmental action, fires, floods, epidemics, quarantines, strikes, embargoes, or severe weather.
General Provisions and Governing Law
This agreement shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns. Neither this agreement nor any variation or modification of this agreement or waiver of any of the terms or provisions hereof shall be deemed valid and binding upon 100% Reef Safe unless in writing, signed by us of 100% Reef Safe and delivered by 100% Reef Safe to Purchaser. Failure by either party to enforce the terms hereof shall not be deemed a waiver of future enforcement of that or any other term. This agreement shall be construed and enforced in accordance with the procedural and substantive Laws in Queensland, Australia (with the exception of the conflicts of law’s provisions of each state).
Notification
Notices under this agreement shall be in writing and forwarded registered or certified mail, postage prepaid. Notices to 100% Reef Safe shall be addressed to 100% Reef Safe; P.O. Box 765, Redcliffe, QLD 4020. Notices to purchaser shall be to the Purchaser's principal business address or at its address set forth on the face of this agreement.
